§ 3-5-7 Wholesale and retail salesdistinguished. – The sale of malt beverages in quantities of more than eight (8) gallons and thesale of vinous beverages and of beverages consisting in whole or in part ofalcohol, which is the product of distillation in quantities of more than three(3) gallons, constitutes a sale by wholesale, and a sale of those beverages inlesser quantities constitutes a sale at retail; provided, that the sale of anyquantity of beverages to a nonlicense holder constitutes a sale at retail.
