Following a jury trial in the Kane County circuit court, thedefendant, Tony Dameron, was convicted of first degree murderfor killing his three-month-old daughter. The defendant waived hisright to a sentencing-phase jury, and the trial court found himeligible for the death penalty. The court then found no mitigatingcircumstances sufficient to preclude the death penalty andsentenced the defendant to death. That sentence has been stayedpending direct review by this court. Ill.
