JUSTICE GEIGER delivered the opinion of the court:

This case arose after the plaintiffs, Scott Stykel, Curt Lamm,John Heilman, and Tave Kraft, took an examination for employment asa firefighter with the City of Freeport (City) that wasadministered by the Illinois Board of Fire and Police Commissioners(Board). The plaintiffs received a score of zero on theexamination, rendering them ineligible for employment. Along withtheir causes of action under the Administrative Review Law (ReviewLaw) (735 ILCS 5/3--101 et seq. (West 1998)), the plaintiffs filedcounts against the defendants, the City of Freeport, the Board ofFire and Police Commissioners, Reginald D. McGee, Brian Borger,Denita Morris, David Schockey, and Mark Wagner, for declaratoryjudgment, breach of implied oral contract, and for violations oftheir civil rights pursuant to section 1983 of the federal CivilRights Act (42 U.S.C.
