Rule 29. Filing, Notice, and Briefs
(a)
Filing. A petition for new trial will be filed with the Judge Advocate General of the service concerned, who, if the case is pending before this Court, will transmit it, together with seven copies, to the Clerk’s office for filing with the Court.
(b)
Notice. Upon receipt of a petition for new trial transmitted by the Judge Advocate General, the Clerk will notify all counsel of record of such fact.
(c)
Briefs. A brief in support of a petition for new trial, unless expressly incorporated in the petition, will be filed substantially in the form specified in Rule
24 no later than 30 days after the issuance by the Clerk of a notice of the filing of the petition. An appellee’s answer shall be filed no later than 30 days after the filing of an appellant’s brief. A reply may be filed no later than 10 days after the filing of the appellee’s answer.
(d)
Special Master. The Court may refer a petition for new trial to a special master, who may be a military judge or other person, to make further investigation, to take evidence, and to make such recommendations to the Court as are deemed appropriate. See United States v. DuBay, 17 USCMA 147 (1967).
