CHAPTER 13 - UTILITY RELOCATION ASSISTANCE
24-13-101. Short title.
Thischapter is known and may be cited as the "Utility Relocation AssistanceAct of 1989".
24-13-102. Definitions.
(a) As used in this chapter:
(i) "Cost of relocation" means the entire amount paidby a utility properly attributable to relocation after deducting therefrom anyincrease in the value of the new facility and any salvage value derived fromthe old facility;
(ii) "Department" means the department oftransportation created by W.S. 24-2-101;
(iii) "Federal-aid highway system" means thefederal-aid primary highway system, the federal-aid secondary highway systemand the interstate system, including extensions of any of them within urbanareas;
(iv) "Interstate system" means any highway now orhereafter included as a part of the national system of interstate and defensehighways provided for in Title 23 of the United States Code;
(v) "Utility" means all publicly, privately andcooperatively owned utilities, regulated and unregulated, supplying utilityservices to or for the public.
24-13-103. Relocation of utility facilities; payment of costs.
Ifthe relocation of any utility facility is necessitated by the construction of aproject on the federal-aid highway system, the owner or operator of thatutility facility shall relocate the facility at its expense and in accordancewith the order of the director of the department of transportation. Uponcompleting the relocation, the department shall determine the cost ofrelocation and may pay any portion of that amount to the utility.
24-13-104. Applicability of chapter.
(a) This chapter does not apply to any taking or damaging ofproperty for which a utility is entitled to compensation pursuant to:
(i) Other applicable law;
(ii) The constitution of this state or of the United States; or
(iii) A binding agreement inuring to the utility's benefit.
