§ 64.1-108. Petition seeking determination of death; notice.
Whenever a petition is filed seeking a judicial determination that a personis dead, the court having jurisdiction over the person's probate estate ifsuch person were dead shall cause to be advertised in a newspaper publishedin the county or city once a week for four successive weeks the fact of thepetition, together with notice that on a certain day, which shall be at leasttwo weeks after the advertisement, the court will hear evidence concerningthe alleged absence of the presumed decedent and the circumstances andduration thereof. The cost of such publication shall be paid by thepetitioner.
