§ 6.1-440. (Repealed effective October 1, 2010) Civil penalties.
A. The Commission may impose a civil penalty not exceeding $1,000 upon anyperson required to be registered hereunder whom it determines, in proceedingscommenced in accordance with the Rules of Practice and Procedure of theCommission, has violated any of the provisions of this chapter or regulationspromulgated thereunder. For the purposes of this section, each separateviolation shall be subject to the civil penalty therein prescribed. Civilpenalties paid pursuant to this chapter shall be deposited to the credit ofthe Literary Fund.
B. Any person who suffers loss by reason of a violation of any provision ofthis chapter may bring a civil action to enforce such provision. Any personwho is successful in such action shall recover reasonable attorney's fees,expert witness fees and court costs incurred by bringing such action.
