§ 46.2-341.20:2. Employer penalty; railroad/highway grade crossingviolations; out-of-service order violation.
Any employer who knowingly allows, permits, authorizes, or requires anemployee to operate a commercial motor vehicle in violation of any law orregulation pertaining to railroad/highway grade crossings, or in violation ofan out-of-service order, shall be subject to a civil penalty of not less than$3,000 nor more than $15,000 for each violation, which shall be imposed bythe Commissioner upon receipt of notification from federal or state motorcarrier officials that an employer may have violated this provision, and uponnotice to the employer of the charge and a hearing conducted as providedunder the Administrative Process Act (§ 2.2-4000 et seq.), to determinewhether such employer has violated this provision. Civil penalties collectedunder this section shall be deposited into the Transportation Trust Fund.
