§ 45.1-161.34. Continuing education requirements.
A. The Board of Coal Mining Examiners shall promulgate regulationsestablishing requirements for programs of continuing education for holders ofcertifications. The Board shall establish (i) the content and amount ofcontinuing education to be required for maintaining certification; (ii)guidelines for the content of continuing education programs; (iii) proceduresfor approving continuing education programs and sponsors; (iv) distributionto holders of certificates of appropriate information regarding continuingeducation requirements; (v) provisions allowing surplus hours of continuingeducation to be carried forward from one period to meet the requirements forthe next period; (vi) procedures for determining compliance with continuingeducation requirements; (vii) requirements for a certificate holder toprovide the Board with his current address and such further administrativeinformation as may be reasonable; and (viii) the length of time a certificatemay be suspended for failure to comply with continuing education requirementsbefore such certificate shall be revoked. The Board may also establish byregulation a fee to recover the reasonable costs of reissuing certificates orotherwise ascertaining that the requirements of this section have beensatisfied.
B. A certification issued by the Board of Coal Mining Examiners shall besuspended if the holder fails to comply with the continuing educationrequirements established by the Board. The suspension shall be vacated uponcompliance with the continuing education requirements. However, if the holderof a certificate does not comply with the continuing education requirementswithin the period of time established by the Board, the certificate shall berevoked.
