§ 37.2-312. Department responsible for education and training programs.
The Department shall be responsible for providing for education and trainingof school-age consumers in state facilities. The Board of Education shallsupervise the education and training provided to school-age consumers intraining centers and provide for and direct the education for school-ageconsumers in state hospitals in cooperation with the Department. Indischarging this responsibility, the Department shall exercise leadership by:(i) coordinating actions with the Department of Education and statefacilities to ensure consistency between treatment and educational prioritiesin the policy and implementation of direct services for school-age consumersin state facilities; (ii) ensuring that comparable resources especially incareer and technical education, appropriate to the students' disabilities andneeds, are available in all state facilities; (iii) monitoring the quality ofthe instruction provided to all school-age consumers in state facilities;(iv) requiring state facility directors to evaluate the performance of theeducation directors pursuant to guidelines developed in cooperation with theBoard of Education; (v) developing and implementing, in cooperation with theDepartment of Education, programs to ensure that the educational andtreatment needs of children with dual diagnoses in state facilities are met;(vi) taking an active role with the Department of Education to evaluate theeffectiveness of prevalent educational models in state facilities; and (vii)designing a mechanism for maintaining constant direct contact and the sharingof ideas, approaches, and innovations between the education directors andteachers whether they are employees of local school divisions or of theCommonwealth who are educating school-age consumers in state facilities.
