§ 36-85.35. Appeals from decision of the Board.
Appeals from a decision of the Board shall be to a circuit court withjurisdiction in the Commonwealth. An appeal must be made within thirty daysof the date of the Board's order. Once made, an appeal shall stay the Board'sorder. Neither the regulant nor the Board shall be required to pay damagesto the claimant until such time as a final order of the court is issued. Thecourt may award reasonable attorney's fees and court costs to be paid by therecovery fund. Except as provided to the contrary herein, appeals pursuant tothis section shall be in conformance with the Administrative Process Act (§2.2-4000 et seq.).
