§ 33.1-356. License required of outdoor advertiser.
No person shall engage or continue in the business of outdoor advertising inthis Commonwealth outside of the corporate limits of municipalities or withinthe corporate limits of municipalities if their off-premises sign,advertisement, or advertising structure is visible from the main traveled wayof any interstate, federal-aid primary, or national highway system highwaywithout first obtaining a license therefor from the CommonwealthTransportation Commissioner. Persons engaged in the business of outdooradvertising who own signs, advertisements, or advertising structures visiblefrom the main traveled way of any interstate, federal-aid primary, ornational highway system highway within municipalities shall have untilOctober 1, 1993, to obtain a license from the Commonwealth TransportationCommissioner or remove such sign, advertisement, or advertising structurefrom the view from the main traveled way of any interstate, federal-aidprimary, or national highway system highway. The Commonwealth TransportationCommissioner shall notify persons known to be engaged in the business ofoutdoor advertising within municipalities by August 1, 1993, of the need toobtain a license. The fee for such license, hereby imposed for revenue forthe use of the Commonwealth, shall be $500 per year, payable annually inadvance. Applications for licenses, or renewal of licenses, shall be made onforms furnished by the Commonwealth Transportation Commissioner, shallcontain such information as the Commonwealth Transportation Commissioner mayrequire and shall be accompanied by the annual fee. Licenses granted underthis section shall expire on December 31 of each year and shall not beprorated. Applications for renewal of licenses shall be made not less thanthirty days prior to the date of expiration. Nothing in this section shallbe construed to require any person who advertises upon a structure or fixtureon his property or a licensed advertiser's structure or other space to obtaina license.
