§ 33.1-239. Appeal to circuit court.

If such applicant, proprietor or tenant is dissatisfied with the decision ofthe board of supervisors or other governing body in respect to the amount ofcompensation or damages allowed, he may of right appeal, but only on thequestion of compensation and damages, to the circuit court of the county,provided such appeal is filed within sixty days. The court shall hear thematter de novo as to the amount of compensation and damages with the furtherright of appeal as provided by general law. Upon the hearing of the appeal,the court shall ascertain the amount of compensation and damages, if any, towhich such proprietor is entitled, and shall certify the same to the board ofsupervisors or other governing body, who shall proceed to carry out thejudgment of the court; provided, however that the board of supervisors orother governing body shall be summoned to appear at the hearing of the appeal.
