§ 33.1-82. Maintenance, etc., by Commonwealth Transportation Commissionerwhen no request for allocation.

If no request is made to the Commonwealth Transportation Board of Virginia bythe governing body of any such town as provided in § 33.1-79, theCommonwealth Transportation Commissioner, subject to the approval of theCommonwealth Transportation Board, may maintain, improve, construct, andreconstruct all streets in such incorporated town that (i) have anunrestricted right-of-way width of not less than thirty feet and a hardsurface width of not less than twelve feet, (ii) were established after July1, 1950, by such town and have a right-of-way width of not less than fiftyfeet and a hard surface width of not less than twenty feet, or (iii) arefunctionally classified as local streets and were constructed on or afterJanuary 1, 1996, and at the time of approval by the town, met the criteriafor pavement width and right-of-way of the then-current edition of thesubdivision street requirements manual for secondary roads of the Departmentof Transportation (24 VAC 30-90-10 et seq.).
