§ 33.1-195. Sale of materials to, and use of equipment by, cities, towns,counties and school boards.
The Board may lend or rent equipment and sell materials and supplies used inthe building or repairing of roads and streets to any city, town, county, orschool board, upon such terms and conditions as may be agreed upon by theBoard and such city, town, county, or school board. Provided the governingbody of such city, town, county, or school board submits to the Board acertificate setting forth that the material or equipment cannot be furnishedfrom private sources within a reasonable time. Provided, further, that theforegoing proviso shall not apply to towns with a population of less than3,500 inhabitants or to the purchase of paint for traffic marking purposes byany city, town, county, or school board.
