§ 33.1-178. Raising or lowering floodgates.

The owner or occupier of a dam shall raise or lower the floodgates on suchdam when there is an impending flood in order to reduce the level of thewater in the pond and when it comes to the attention of the CommonwealthTransportation Commissioner, or his authorized agent, that this has not beendone, or that the owner is unable to reach the spillway in order to do so,the Commissioner, or his authorized agent, may perform this duty.
