§ 32.1-297. Action for implied warranty in connection with transfer of bloodor human tissue.
No action for implied warranty shall lie for the procurement, processing,distribution or use of whole blood, plasma, blood products, blood derivativesand other human tissue such as corneas, bones, or organs for the purpose ofinjecting, transfusing or transplanting any of them into the human bodyexcept where any defects or impurities in the said whole blood, plasma, bloodproducts, blood derivatives and other human tissue such as corneas, bones, ororgans are detectable by the use of established medical and technologicalprocedures employed pursuant to the standards of local medical practice.
