§ 32.1-232.1. Special Trust Fund for Radioactive Materials Facility Licensureand Inspection created.
There is hereby created in the Department of the Treasury a specialnonreverting fund known as the Special Trust Fund for Radioactive MaterialsFacility Licensure and Inspection, hereinafter referred to as the "Fund."The Fund shall be established on the books of the Comptroller, and any moneysremaining in the Fund at the end of the biennium shall not revert to thegeneral fund but shall remain in the Fund. All deposits of fees collectedpursuant to subdivision 6 of § 32.1-229 shall be paid into the Department ofthe Treasury and credited to the Fund; in addition, the Fund shall consist ofsuch funds as may be appropriated for the purpose of licensure and inspectionof radioactive materials facilities, and such gifts, donations, grants,bequests, and other funds as may be received on its behalf. Interest earnedon such moneys shall remain in the Fund and be credited to it. Moneys in theFund shall be used solely to support the Department of Health's program forlicensure and inspection of radioactive materials facilities as provided inthis article and Board of Health regulations. Disbursements from the Fundshall be made by the State Treasurer on warrants issued by the Comptrollerupon written request of the Commissioner of Health.
