§ 32.1-29. Employment of attorney to defend Board members, employee, etc.
If the Commissioner, any Board member or any officer or employee of theDepartment is arrested, indicted or otherwise prosecuted on any criminalcharge arising out of any act committed in the discharge of his duties assuch, the Commissioner may employ an attorney approved by the AttorneyGeneral to defend such person. The compensation for such attorney shall,subject to the approval of the Attorney General, be paid out of the fundsappropriated for the administration of the Department.
