§ 30-302. (Expires July 1, 2011) Membership; terms.
The Commission shall have a total membership of 15 members that shall consistof eight legislative members, four nonlegislative citizen members, and threeex officio members. Members shall be appointed as follows: three members ofthe Senate, to be appointed by the Senate Committee on Rules; five members ofthe House of Delegates, to be appointed by the Speaker of the House ofDelegates in accordance with the principles of proportional representationcontained in the Rules of the House of Delegates; two nonlegislative citizenmembers with expertise in energy issues, to be appointed by the Speaker ofthe House of Delegates; two nonlegislative citizen members with expertise inenergy issues, to be appointed by the Senate Committee on Rules; and onemember of the staff of the State Corporation Commission, to be appointed bythe Commissioners of the State Corporation Commission, the Director of theDepartment of Environmental Quality or his designee, and the Director of theDepartment of Mines, Minerals and Energy or his designee. The one member ofthe staff of the State Corporation Commission, the Director of the Departmentof Environmental Quality or his designee, and the Director of the Departmentof Mines, Minerals and Energy or his designee, all to serve ex officio withnonvoting privileges.
Legislative members of the Commission shall serve terms coincident with theirterms of office and ex officio members shall serve at the pleasure of theappointing authority. Nonlegislative citizen members of the Committee shallserve for terms of four years. Appointments to fill vacancies, other than byexpiration of a term, shall be for the unexpired terms and shall be made inthe same manner as the original appointment. Nonlegislative citizen membersshall not be eligible to serve more than two consecutive four-year terms. Theremainder of any term to which a member is appointed to fill a vacancy shallnot constitute a term in determining the member's eligibility forreappointment.
The Commission shall elect a chairman and vice-chairman from among itsmembership who shall be members of the General Assembly.
