§ 3.2-4809. Inspection, sampling, and analysis.
A. The Commissioner may enter and inspect any factory, warehouse, orestablishment within the Commonwealth during operating hours in whichcommercial feed is manufactured, processed, packed, warehoused, sold, or heldfor distribution, or any vehicle used to transport or hold such feed, todetermine whether the provisions of this chapter have been complied with,including whether or not any operations may be subject to such provisions.The inspection shall include the verification of only such records andproduction and control procedures, pertinent equipment, finished material,unfinished material, any container, and labeling therein as may be necessaryto determine compliance with this chapter.
B. The Commissioner may obtain samples from any premises during operatinghours or any vehicle enumerated in subsection A, and examine records relatingto distribution of commercial feeds.
C. When the inspection and analysis of an official sample indicates acommercial feed has been adulterated, misbranded, or is otherwise deficientunder the provisions of this chapter, the Commissioner shall, upon request,furnish to the licensee a portion of the sample concerned within 30 daysfollowing the receipt of such analysis by the licensee.
D. The Commissioner, in determining for administrative purposes whether acommercial feed is deficient in any component, shall be guided by theofficial sample. Such official sample shall be obtained and analyzed asprovided in § 3.2-4801.
E. The Commissioner shall allocate adequate personnel to the major farm feedconsuming areas of the state to carry out his duties under this act as suchduties relate to insuring the quality, analysis, and quantity of feed soldand distributed in the Commonwealth.
