§ 3.2-3608. Contractor-applicator permit.
A. It is unlawful for any person, other than a licensee or an agent of alicensee, to distribute or apply any regulated product for profit withoutobtaining a permit. In order to obtain a permit the person shall complete anapplication form furnished by the Commissioner and pay the $50 annual permitfee required to be a contractor-applicator. An employee or agent of acontractor-applicator who holds a valid permit is not required to obtain apermit or pay a fee.
B. Any person who engages in business as a contractor-applicator for a periodof at least 30 days, and who has failed to obtain a license or permit duringthat period, shall pay a $50 late fee to the Commissioner, in addition to thelicense or permit fee.
C. The contractor-applicator shall guarantee the consumer that thecontractor-applicator shall comply with all provisions of this chapter, whichshall include an assurance of the delivery of the grade of fertilizer asdescribed on the consumer's invoice.
