§ 28.2-510. Buying, selling, or possessing unculled oysters; penalty.
It is unlawful for any person to buy, sell, or possess oysters under theprescribed size and over the shell allowance taken from the public rocks,beds, and shoals. If upon trial for this offense the accused person assertsthe claim or defense that the unculled oysters were taken from privateplanting grounds, the burden of proving such a defense or fact shall be uponthe accused.
A violation of any provision of this section is a Class 3 misdemeanor.
