§ 26-89. Agent's resignation; notice.
Unless the power of attorney provides a different method for an agent'sresignation, an agent may resign by giving notice to the principal and, ifthe principal is incapacitated:
1. To the conservator or guardian, if one has been appointed for theprincipal, and a coagent or successor agent;
2. If there is no person described in subdivision 1, to an adult who is aspouse, child or other descendant, parent, brother or sister of the principal;
3. If none of the foregoing persons is reasonably available, another personreasonably believed by the agent to have sufficient interest in theprincipal's welfare; or
4. If none of the foregoing persons is reasonably available, the adultprotective services unit of the local department of social services for thecounty or city where the principal resides or is located.
