§ 24.2-443.1. Eligibility for temporary registration.
A. The provisions of this article shall apply to:
1. Any person who has been registered to vote pursuant to Article 4 (§24.2-417 et seq.) of this chapter, who moves overseas for purposes ofemployment, and who would continue to be eligible for permanent registrationpursuant to Article 4 except for the fact that he has relinquished his placeof abode in Virginia;
2. A spouse residing with a person who moves overseas for purposes ofemployment if the spouse has been registered to vote pursuant to Article 4 (§24.2-417 et seq.) of this chapter and would continue to be eligible forpermanent registration pursuant to Article 4 except for the fact that theyhave relinquished their place of abode in Virginia; and
3. A dependent residing with a person who moves overseas for purposes ofemployment if the dependent has been registered to vote pursuant to Article 4(§ 24.2-417 et seq.) of this chapter and would continue to be eligible forpermanent registration pursuant to Article 4 except for the fact that theyhave relinquished their place of abode in Virginia.
B. The eligibility of a spouse or dependent to register pursuant to theprovisions of this article shall be deemed separate from, and shall notdepend on, the eligibility of the employee who moves overseas.
C. Temporary registration pursuant to this article shall entitle the overseasemployee, the spouse or the dependents to vote in any state or local electionheld in the precinct in which the place of abode relinquished by the overseasemployee, spouse or dependents is located provided that the individualseeking to register was both registered at and a resident of that place ofabode immediately prior to moving overseas. Temporary registration pursuantto this article shall be permitted for the overseas employee, his spouse ordependent residing with him, only so long as the overseas employee, spouse,or dependent votes at least once every five years in an election held in theprecinct in which he had been registered immediately preceding his movingoverseas.
D. The provisions of this article shall apply to any person otherwise meetingthe qualifications of this article who moved overseas on or after July 1,1999.
