§ 2.2-1404.1. Use of vendors identified by public institutions of highereducation as small, women- and minority-owned businesses.
For purposes of compliance with § 2.2-4310, a public institution of highereducation that meets the conditions prescribed in subsection B of § 23-38.88may procure goods, services, and construction from vendors identified by suchpublic institutions of higher education as small, women-owned, andminority-owned businesses that the institution has certified as such based oncriteria approved by the Department. An institution exercising the authoritygranted by this section shall establish and follow internal procedures andprocesses designed to verify whether or not a vendor qualifies to becertified as a small, women-owned, and minority-owned businesses under theDepartment approved criteria and the certification requirements. Theinstitution shall notify the Department promptly of the certification, andshall provide the Department with a copy of its written certificationidentifying the vendor as small, women-owned, and minority-owned businessesand all application materials submitted by the vendor to the institution.Such certification shall remain in effect unless and until the Departmentnotifies the institution that the vendor does not meet the certificationrequirements.
An institution exercising authority granted under this section shall promptlymake available to the Department, upon request, copies of its procurementrecords, receipts, and transactions in regard to procurement from small,women-owned, and minority-owned businesses in order for the Department toensure institution compliance with its approved reporting and certificationcriteria.
