§ 10.1-1322.1. Air Pollution Permit Program Fund established; use of moneys.
A. Notwithstanding the provisions of § 2.2-1802, all moneys collectedpursuant to §§ 10.1-1322 and 10.1-1322.2 shall be paid into the statetreasury and credited to a special nonreverting fund known as the AirPollution Permit Program Fund, which is hereby established.
B. Any moneys remaining in the Fund shall not revert to the general fund butshall remain in the Fund. Interest earned on such moneys shall remain in theFund and be credited to it.
C. The Department of Air Pollution Control is authorized and empowered torelease moneys from the Fund, on warrants issued by the State Comptroller,for the purposes of carrying out the provisions of this chapter under thedirection of the Executive Director.
D. An accounting of moneys received by and distributed from the permit fundshall be kept by the Comptroller and furnished upon request to the Governoror the General Assembly.
