§ 10.1-119. Defense of conservation officer of the Department prosecuted oncriminal charges.
If any conservation officer appointed by the Director shall be brought beforeany regulatory body, summoned before any grand jury, investigated by anyother law-enforcement agency, or arrested or indicted or otherwise prosecutedon any charge arising out of any act committed in the discharge of hisofficial duties, the Director may employ special counsel approved by theAttorney General to defend such officer. Upon a finding that (i) the officerdid not violate a law or regulation resulting from the act that was thesubject of the investigation and (ii) the officer will not be terminated fromemployment as the result of such act, the Director shall pay for the specialcounsel employed. The compensation for special counsel employed pursuant tothis section shall, subject to the approval of the Attorney General, be paidout of the funds appropriated for the administration of the Department ofConservation and Recreation.
