§ 2307. -Notice of appointment; account; payment to trustee; appeal
(a) Upon the petition of an executor or administrator for the appointment of a trustee under the provisions of sections 2305 and 2306 of this title, notice shall be given as provided by the rules of probate procedure and the same proceedings shall be had as upon the allowance of an administrator's account.
(b) The executor or administrator shall render to the probate court an account of the moneys or securities representing the legacy or distributive share of the absent person in the hands of the executor or administrator, and all reasonable charges and expenses pertaining to the care and management thereof. On order of the probate court, the executor or administrator shall turn over and pay to the trustee so appointed by the court to receive the same the sums due the absent person, and thereupon the executor or administrator shall be discharged from further liability in the premises.
(c) The same appeal may be had from the appointment of a trustee as from the appointment of administrators and upon the settlement of their accounts. (Amended 1985, No. 144 (Adj. Sess.), § 102.)
