§ 3010. Resignation of agent for service of process
(a) An agent for service of process may resign an agency appointment by signing and filing with the secretary of state the signed original and two exact or conformed copies of a statement of resignation which may include a statement that the designated office is also discontinued. The statement must include or be accompanied by a certification from the agent that written notice of the resignation has been mailed or delivered to the limited liability company or foreign limited liability company at its last known address. Such certification shall include the name of the individual notified, if any, and the address to which the notice was mailed or delivered.
(b) After filing a statement of resignation, the secretary of state shall mail a copy to the designated office (if not discontinued) and another copy to the limited liability company or foreign limited liability company at the address certified in the statement of resignation.
(c) An agency is terminated on the 31st day after the statement was filed. (Added 1995, No. 179 (Adj. Sess.), § 4.)
