8-30-219. Oaths and subpoena powers.

(a)  The commission and the commissioner of personnel have the power to administer oaths, subpoena witnesses, and compel the production of records pertinent to any investigation or hearing authorized by this part or part 3 of this chapter. Any person who shall fail to appear in response to a subpoena or to answer any question or produce any record pertinent to any such investigation or hearing, or who shall knowingly give false testimony therein, commits a Class A misdemeanor.

(b)  Witnesses shall be subpoenaed upon the application of any party to an appeal as authorized by § 8-30-328, and the witnesses shall be paid the same fees and per diem as witnesses are paid in the courts. The commission shall have the power to adjudge the costs in all appeals as may be deemed just and proper at the discretion of the commission. In the event such costs are adjudged against any state department or agency, the same shall be paid by the department. In addition, the commission is hereby authorized and empowered to make reasonable rules and regulations concerning the application for subpoenas and adjudging the costs of witnesses in the event of continuances.
