57-8-104. Power to enter structure to obtain sample Refusing sample or interfering with inspector a misdemeanor.
(a) The department of agriculture, through any inspector or duly authorized assistants, shall have power at all times to enter every building, room, basement, or cellar used or suspected of being used for the conducting of a soft drink stand, and to take samples of soft drinks therein kept for sale upon paying or offering to pay to the person in charge of such soft drink stand, the regular market price of the sample so taken.
(b) It is unlawful for any person in charge of such establishment or any clerk or other employee thereof to refuse to turn over the sample required or in any manner to interfere with the inspector or assistants, and any person so refusing or interfering with the inspector or assistants is guilty of a Class C misdemeanor.
