57-3-405. Solicitation of business restricted.
(a) It is unlawful for any representative, employee, or agent of any distiller, rectifier or manufacturer, to solicit business from anyone in this state except those holding a wholesaler's license to do business in this state.
(b) (1) No holder of a license issued under this chapter shall employ any canvasser or solicitor for the purpose of receiving an order from a consumer for any alcoholic beverages at the residence or place of business of such consumer, nor shall any such licensee receive or accept any such order which shall have been solicited or received at the residence or place of business of such consumer.
(2) This subsection shall not be construed so as to prohibit the solicitation by a distiller, rectifier or vintner of an order from any licensed wholesaler at the licensed premises of such wholesaler, nor to prohibit the solicitation by a licensed wholesaler of an order from any licensed retailer at the licensed premises.
