54-13-307. Ferryboat Construction.

The owner and keeper of every ferry shall keep a good and substantial boat, with safe banisters, at least three feet (3¢) high, with a sufficient number of horizontal rails to prevent the escape of all kinds of stock, the first two (2) rails from the gunwale not to be farther apart than four inches (4²), unless the ferry operator is relieved by the county legislative body from this duty, upon it being shown to its satisfaction that, owing to the nature of the banks or the swiftness of the current, it is not practicable, without great difficulty, to carry the boat across the stream with the handrails.
