46A-14-3. Formation of watershed district in conservation districts--Petition to hold hearings and put to vote--Boundaries--Appointment of first board of managers. Conservation districts are hereby vested with jurisdiction, power, and authority, upon filing of an initiating petition to hold hearings and put to a vote the creation of a district and, if favorable, to establish a watershed district and define and fix the boundaries thereof, which may be entirely within or partly within a county or conservation district, and include the whole or any part of one or more counties or conservation districts, and to appoint the first board of managers thereof, as provided in this chapter. If the proposed district embraces land in more than one conservation district, the supervisors of all such conservation districts shall act jointly as a board of supervisors with respect to all matters concerning watershed districts which are herein specified for a single conservation district. If no conservation district exists which embraces lands proposed for inclusion in a proposed watershed district, the Board of Water and Natural Resources shall function in lieu thereof.
