46A-6-5. Drainage of land by district--Providing of necessary funds--Surveys--Eminent domain--Contract with United States. Any irrigation district heretofore organized or hereafter to be organized may whenever it appears necessary, proper, or beneficial to drain any of the land within said district, either for the benefit of the land actually requiring drainage or for the protection of other lands within said district, whether the irrigation works have been actually acquired or constructed or not, cause drainage canals and works to be constructed, and for such purpose such district shall have all the authority herein granted for levying special assessments or otherwise providing funds necessary properly to drain such lands, entering upon lands for the purpose of making surveys, exercising the right of eminent domain, contracting for the construction of necessary ditches, and further shall have the right to extend such drainage ditches outside of the limits of such district for the purpose of conducting the drainage water to other lands upon which the same may be lawfully used or to return the same to some natural watercourse. The powers herein granted shall include the power to enter into a contract with the United States of America to carry out and effectuate all proper drainage of the district or any part thereof, and any such contract shall be treated, to all intents and purposes, as if made under the provisions of this chapter.
