46A-5-12. Authority of board of directors--Acquisition of property--Actions to enforce and protect rights under law--Suits by and against, maintenance in person or by attorney in name of district. The board of directors is hereby authorized to take conveyances or other assurances for all property acquired by it under the provisions of chapters 46A-4 to 46A-7, inclusive, in the name of such irrigation district, to and for the uses and purposes herein expressed, and to institute and maintain any and all actions and proceedings at law or in equity, necessary or proper in order to carry out fully the provisions of said chapters, and to enforce, maintain, protect, or preserve any and all rights, privileges, and immunities created by said chapters or acquired in pursuance thereof. In all actions or proceedings the board may sue, appear, and defend, in person or by attorney, and in the name of such irrigation district.
