Section 41-21-3 - Declaration of nuisance by county commissioners.
41-21-3. Declaration of nuisance by county commissioners. Any board of county commissioners may declare a forest insect or disease to be a public nuisance within its jurisdiction when in the opinion of the board such insect or disease constitutes a serious threat to the forest and tree resources of the county. The remaining provisions of this chapter are in effect in any county where a forest insect or disease has been declared to be a public nuisance in the manner prescribed above.
