40-6-17. Veterinary examination on protest of diagnosis--Expenses of examination. Upon the filing of a protest pursuant to § 40-6-16, an examination of the animal involved shall be made by three licensed veterinarians, one selected by the Animal Industry Board, one selected by the person making the protest, and the third appointed by the two thus selected. If two of them find the animal to be free from such infectious, contagious, or transmissible disease, the expense of the examination shall be paid by the state. However, if two of them find such animal to be affected with such infectious, contagious, or transmissible disease, the expense of the examination shall be paid by the person making the protest. The board and the person making the protest are bound by the result of the examination.
