34A-1-47. Notice of violation--Order for corrective action included--Violator subject to civil penalty. If the secretary has reason to believe that a violation of any provision of this chapter or rule pursuant thereto has occurred, he may cause written notice to be served upon the alleged violator. The notice shall specify the provision of this chapter or rule alleged to be violated, and the facts alleged to constitute a violation thereof, and may include an order that necessary corrective action be taken within a reasonable time. Any person who violates an order pursuant to this section is subject to a civil penalty not to exceed ten thousand dollars per day of violation, or for damages to the environment, or both.
