§ 8-8-4 Habeas corpus. – The district court may issue writs of habeas corpus to bring before it anyperson in jail for trial in any civil or criminal case pending in the court, orto bring in any such person to be examined as a witness in a suit orproceeding, civil or criminal, pending in the court, that the ends of justicemay be attained, and for no other purpose.
