§ 6-13.1-25 Penalties. A violation of § 6-13.1-21, 6-13.1-22 or 6-13.1-23 shall constitute adeceptive trade practice for enforcement purposes. Any credit bureau whichnegligently fails to comply with the requirements imposed under this chapterwith respect to any consumer and which does not achieve compliance within three(3) working days of being notified of its noncompliance by the consumer isliable to that consumer in an amount equal to the sum of ten dollars ($10.00)per day for each day of noncompliance, beginning on the fourth day followingthe date that the credit bureau is notified by the consumer of thenoncompliance; provided that there is noncompliance as determined by the court,plus any actual damages sustained by the consumer as a result of the negligentfailure; and in the case of any successful action to enforce any provisionunder this chapter, the costs of the action together with reasonable attorney'sfees as determined by the court.
