SECTION 5-10-2
§ 5-10-2 Creation of division ofprofessional regulation and board of barbering and hairdressing Powersand duties. (a) Within the department of health there is a division of professionalregulation and a board of barbering and hairdressing. The division shall:
(1) Approve all written and practical examinations;
(2) Issue all licenses and permits subsequently provided forin this chapter;
(3) Serve as the sole inspector of sanitation of allestablishments licensed under this chapter;
(4) Make any rules and regulations that the division deemsnecessary or expedient, in conformity with the provisions of this chapter andnot contrary to law, for the conduct of the business of barbering andhairdressing and cosmetic therapy or esthetics and manicuring, for the use ofappliances, apparatus, and electrical equipment and machines and theestablishment of sanitary requirements in all establishments and of all personslicensed under the provisions of this chapter;
(5) Keep a register of all persons and places of businesslicensed under this chapter;
(6) Keep complete records of all persons and establishmentslicensed under this chapter;
(7) Summon witnesses and administer oaths; and
(8) Do all things and perform all acts necessary to enforcethe provisions of this chapter.
(b) The board of barbering and hairdressing shall have apolicy-making role in selection of the examinations. Subsequent to theadministration of the examination, the board of examiners shall review theexaminations to evaluate their effectiveness. The board shall supervise theoperations of the division of professional regulation in an advisory capacityin promulgating any policy that is necessary to improve the operations of thedivision in their areas of expertise. The promulgation of that policy issubject to the approval of the director of the department. Members of the boardare subject to the provisions of chapter 14 of title 36.
