§ 46-22-15 Owner's civil liability. The owner of a vessel shall be liable for any injury or damage occasioned bythe negligent operation of the vessel, whether the negligence consists of aviolation of the provisions of the statutes of this state, or neglecting toobserve such ordinary care and such operation as the rules of the common lawrequire. The owner shall not be liable, however, unless the vessel is beingused with his or her express or implied consent. It shall be presumed that thevessel is being operated with the knowledge and consent of the owner, if at thetime of the injury or damage, it is under the control of his or her spouse,father, mother, brother, sister, son, daughter, or other immediate member ofthe owner's family. Nothing contained herein shall be construed to relieve anyother person from any liability which he or she would otherwise have, butnothing contained herein shall be construed to authorize or permit any recoveryin excess of the injury or damage actually incurred.
