§ 42-66.2-8 Penalties. (a) Criminal penalties. Any person who submits a false or fraudulentclaim under this chapter, or who aids or abets another in the submission of afalse or fraudulent claim, or who is eligible under a private, state, orfederal program for prescription assistance and who claims or receivesduplicative benefits hereunder or who otherwise violates any provisions of thischapter is deemed guilty of a misdemeanor and is subject to imprisonment for aterm of not more than one year or a fine of not less than five hundred dollars($500), or both.
(b) Any provider or consumer found guilty of intentionallyviolating the provisions of this chapter shall be subject to immediatetermination from this program for a period of no less than one year.
(c) Repayment of gain. Any provider or consumer who isfound guilty under this chapter is subject to repay three (3) times the valueof the material gain he or she received.
