SECTION 42-60-9

   § 42-60-9  Orders, rules, and regulations.– (a) The governor may make, amend, and rescind any orders, rules, andregulations that he or she may deem advisable to carry out the provisions ofthis chapter.

   (b) All orders, rules, and regulations promulgated by thegovernor shall become effective immediately except as provided in subsection(c).

   (c) All orders by the governor to amend or suspend certainstate rules and regulations in effect prior to the declaration of an energycrisis may become effective no sooner than forty-eight (48) hours after thegovernor has notified the joint committee on legislative services of the ordersand the effective dates of these orders. The orders to amend or suspend staterules and regulations shall become effective unless the committee disapprovesthe orders within forty-eight (48) hours by a majority vote; provided, however,that the orders shall be effective immediately if approved by the majority ofthe committee. Thereafter, all of the effective orders, rules, or regulationsshall have the full force and effect of law, when, in the event of issuance bythe governor, a copy is filed in the office of the secretary of state. Allexisting provisions of any regulatory statute prescribing the procedures forthe conduct of state business, rules and regulations inconsistent with theprovisions of this chapter, or inconsistent with any order, rule, or regulationissued under the authority of this chapter shall be suspended during the periodof time and to the extent that the conflict exists. All orders, rules, andregulations promulgated by the governor pursuant to this chapter shallterminate with the termination of the energy crisis.

   (d) In order to attain uniformity so far as practicablethroughout the country in measures taken to aid in energy crisis management,all action taken under this chapter and all orders, rules, and regulations madepursuant to this chapter, where not already specifically provided for, shall betaken or made with due consideration to the orders, rules, regulations,actions, recommendations, and requests of federal authorities relevant to theseand, to the extent permitted by law, shall be consistent with these orders,rules, regulations, actions, recommendations, and requests.
