§ 42-28-25.1 - Trainee compensation for death, disability, or injury.

SECTION 42-28-25.1

   § 42-28-25.1  Trainee compensation fordeath, disability, or injury. – (a) All trainees of the state police training academy shall be compensated fordeath, disability, or injury incurred while in training under the provisions ofthis chapter as follows:

   (1) All medical expenses incurred as a result of such injuryshall be paid by the state; and

   (2) Death and disability payments shall be paid in accordancewith § 42-28-21 and § 45-19-1 relating to compensation for injuriescausing disability or causing death to full-time members of the state police inthe course of performance of their duties.

   (b) In the computation of the benefits set forth in §42-28-21(b), any member of the state police training academy suffering aninjury causing disability or death, shall be construed to have been receivingthe amount of salary to the lowest grade of full-time members of the statepolice at the time of injury or death unless the disability as a result ofinjury incurred in the state police training academy occurs subsequent to thetrainee being sworn in as a member of the state police, in which case thebenefits shall be computed based upon the highest rank attained by theindividual at the time of disability.
