§ 42-17.2-2 - Definitions.

§ 42-17.2-2 Definitions. The following terms shall be construed as follows:
(1) "Department" means the department of environmentalmanagement.
(2) "Industry" means the activities of all those persons inthe state who own or control the operation of passenger tramways.
(3) "Operator" is a person who owns or controls the operationof a passenger tramway. The word "operator" includes the state or any politicalsubdivision.
(4) "Passenger tramway" means a device used to transportpassengers uphill on skis or in cars on tracks or suspended in the air, by theuse of steel cables, chains or belts or by ropes and usually supported bytrestles or towers with one or more spans. The term "passenger tramway"includes the following:
(i) "Chair lift" , a type of transportation on whichpassengers are carried on chairs suspended in the air and attached to a movingcable, chain or link belt supported by trestles or towers with one or morespans, or similar devices.
(ii) "Jay bar, T bar, poma lift, platter pull, so called" ,and similar types of devices, are means of transportation which pull skiersriding on skis by means of an attachment to a main overhead cable supported bytrestles or towers with one or more spans.
(iii) "Multi-car passenger tramway" , a device used totransport passengers in several open or enclosed cars attached to, andsuspended from, a moving wire rope, or attached to a moving wire rope andsupported on a standing wire rope, or similar devices.
(iv) "Rope tow" , a type of transportation which pulls theskiers riding on skis as the skier grasps the rope manually, or similar devices.
(v) "Skimobile" , a device in which a passenger car runningon steel or wooden tracks is attached to and pulled by a steel cable, orsimilar devices.
(vi) "Two-car passenger tramway" , a device used to transportpassengers in two (2) open or enclosed cars attached to, and suspended from, amoving wire rope, or attached to a moving wire rope and supported on a standingwire rope, or similar devices.
