§ 42-12-9 Rehabilitation of disabledpersons. The state department of human services is hereby authorized to provide suchmedical, diagnostic, physical restoration, training, and other rehabilitationservices as may be needed to enable disabled individuals, including thosesuffering from acquired traumatic brain damage, to attain the maximum degree ofself care. The powers herein delegated and authorized for the state departmentof human services shall be in addition to those previously authorized by anyother law. This provision shall become effective when and if federalgrant-in-aid funds are authorized and appropriated by Congress forparticipation in the cost of independent living rehabilitation services fordisabled persons in order to enable them to attain the maximum degree of selfcare. In the event the Congress of the United States, by legislative act orappropriation, authorizes the establishment of such a state-federalgrant-in-aid program, the state department of human services shall beauthorized to co-operate with whatever federal agency is directed to administerthe federal aspects of the program and to comply with such requirements andconditions as may be established and the receipt and disbursement of federalgrant-in-aid funds which may be made available to the state of Rhode Island incarrying out the program. Provided however, with respect to those personssuffering from acquired traumatic brain damage, the department of humanservices shall not have any jurisdiction over the housing of said persons.
