SECTION 42-12-8

   § 42-12-8  Vocational rehabilitationservices provided by department. – The state department of human services is hereby authorized and empowered toprovide for the vocational rehabilitation of persons with disabilities andtheir return to civil employment. If any person, by reason of disability,whether congenital or acquired by accident, injury or disease, including thosepersons suffering from acquired traumatic brain damage, is or may be expectedto be totally or partly incapacitated for remunerative employment, the statedepartment of human services may, if the person is a suitable subject forrehabilitation, assist in rendering him or her fit to engage in remunerativeoccupation by providing directly or through public or privateinstrumentalities, any service found by the department of human services to benecessary to compensate a person who is disabled for his or her employmentbarrier; such services including but not limited to, medical and vocationaldiagnosis, vocational guidance, counseling and placement, rehabilitationtraining, physical restoration including prosthetic appliances, transportation,occupational licenses, customary tools and equipment, maintenance and trainingbooks and materials, and neuropsychological evaluation and cognitiveretraining. Provided however, with respect to those persons suffering fromacquired traumatic brain damage, the department of human services shall nothave any jurisdiction over the housing of said persons.
